VI Outlines TSCA Reform Priorities

VI has joined 151 associations and companies sending a letter to the House and Senate leadership and staff currently negotiating a final TSCA reform bill. The letter calls for quick negotiation on compromise legislation and outlines the industry’s top priorities to include in a final agreement.
Progress on negotiations has been slow this year, though VI and industry allies remain hopeful. A key point of contention is the extent to which state laws should be preempted. Businesses and manufacturers have argued that strong federal preemption would prevent a patchwork of state regulatory regimes to navigate.
A recently obtained letter from EPA Administrator, Gina McCarthy doesn’t take a strong position on the issue of preemption but does appear to favor allowing some states to maintain their regulatory systems like Prop 65 in California. Although the Senate bill would pause new state chemical regulatory systems from being adopted, there is a grandfathered clause for current ones.
